Magnetix Toy Recall Lawyers

After reports of serious injuries and one death, the US Consumer Product Safety Commission (CPSC) announced a voluntary recall of the popular children’s toy Magnetix building set. The set contains several small elements, including tiny magnets that pose a significant risk of injury or even death in children who swallow the parts. Despite the warnings, Magnetix maker Mega Bloks of Canada and its subsidiary Rose Art, are not discontinuing the harmful toys.

Several stores and state officials are taking action against the toys and removing them from their shelves. Magnetix’s maker stated that it believes that the toy poses no risk to children aged six or above - the age group that is labeled on the boxes of their toys. Critics contend that any toy that has resulted in 34 incidents of injury and one death should no longer be allowed to remain on store shelves.

The controversy surrounding Magnetix revolves around a 22-month-old boy, Kenny Sweet who swallowed eight of the magnets that had fallen out of the building set. The magnets lodged in the boy’s intestines and clamped together in his body causing a fatal blockage. Another three children aged three to eight had to undergo serious surgical procedures after they swallowed magnets as well. Another 5-year-old aspirated two magnets and they had to be surgically removed from his lung.

Despite the rash of injuries and the tragic death of Kenny Sweet, Magnetix remains on store shelves around the world. The toy’s maker is offering concerned parents an exchange for another toy on their website but has not taken responsibility for any of the injuries. Lawsuits have already been filed in several cases and many more are expected to follow.
