We live in a complex and technical world in which we expect the products we purchase and use to be designed and manufactured in such a manner that they are safe for our use. We also expect that the sellers and manufacturers of products will give us reasonable warnings of dangerous propensities of their products.
Unfortunately, not all designers, manufacturers and sellers of products live up to these expectations and the requirements of our laws with regard to their products. There are three basic ways in which a product may be considered defective.
DESIGN
Design defects exist before the product is manufactured. While it may be designed to fit the purpose, it can be dangerous to use.
MANUFACTURE
Manufacturing defects happen when the product is manufactured. Often only a percentage of the overall number of products manufactured are considered to be defective.
MARKETING
Marketing defects occur when there is a failure to give proper instructions and warnings to the consumer of the dangers of the product.
You must show the product to be defective in order to pursue legal action against the manufacturer or supplier of the product. It is irrelevant whether the manufacturer or supplier of the product was aware of the defect. The fact that the product causes harm warrants liability.
