$700,000 Jury Verdict Against
Southern California Edison

A Los Angeles jury has awarded $700,000 in damages to a 14-year-old boy blinded by a Southern California Edison employee who shot him in the eye with a paintball gun while on duty outside of the town of Big Creek, located in the Sierra National Forest, about 45 minutes from Fresno.
Brian Chase, the lead attorney for the boy, alleged that Edison threw away the employee's handwritten account of the accident. "They said they typed up a more formal statement on her behalf to correct her typos," said Brian Chase. "But it just looked like lawyers were writing the witness statement to clear the company of liability".
The incident occurred in March 2003, when a water quality specialist stepped away from her field duties monitoring water levels to help several kids playing paintball in the woods surrounding Edison's Big Creek facility.
The Edison employee claimed at the trial that she only intended to scare off several bigger kids who were teaming up on a few younger boys. But, after luring one of the boys toward her, she whipped out a concealed paintball gun and fired, hitting him point blank in the eye.
A teenager was blinded," said Brian Chase. "For the rest of his life, he has to confront the serious challenges that come with permanent loss of vision in his right eye. The jury understood the gravity of the situation. This is not like a broken arm that will heal with a cast and an apology."
"The verdict is notable for the size of the damage award and for the fact that the jury found Southern California Edison was responsible for the actions of its employee.", said Chase.
